Alpha AI (“we,” “our,” “us”) respects the intellectual property rights of others and expects all users of our website and services to do the same.
In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), this policy outlines the procedures for submitting notices of alleged copyright infringement and counter notifications for the restoration of removed materials.
As an internet service provider, MARIDA LIMITED is entitled to the “safe harbor” protections under the DMCA, provided that we act in good faith upon receiving valid infringement notices.
2. Notice of Infringement (Claim Procedure)
If you believe that content hosted or distributed through Alpha AI infringes upon your copyrighted work, you may submit a DMCA takedown notice to our designated DMCA Agent. Your notification must include the following information, as required under 17 U.S.C. §512(c)(3):
A physical or electronic signature of the copyright owner or the person authorized to act on behalf of the owner.
Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
Identification of the infringing material to be removed, and information reasonably sufficient to allow Alpha AI to locate the material (e.g., specific URL or content reference).
Contact information of the complaining party, including full name, address, email address, and telephone number.
A statement that the complaining party has a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
3. False or Misleading Claims
Under17 U.S.C. §512(f), any person who knowingly and materially misrepresents information in a DMCA notice may be subject to civil liability, including damages, legal fees, and costs.
Alpha AI will not tolerate abuse of the DMCA process and reserves the right to pursue damages for fraudulent or bad-faith claims.
4. Counter Notification (Restoration Request)
If you believe that content you posted on Alpha AI was removed or disabled as a result of mistake or misidentification, you may submit a counter notification. Your counter notice must include the following elements, as set out in 17 U.S.C. §512(g)(3):
Your physical or electronic signature.
A description of the material that was removed and the original location (URL or identifier) before removal.
A statement, under penalty of perjury, that you have a good faith belief the content was removed or disabled by mistake or misidentification.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or, if outside the United States, to the jurisdiction of any judicial district in which the service provider may be found).
A statement that you will accept service of process from the person or entity who filed the original DMCA complaint.
Please submit counter notifications to the same DMCA Agent listed above.
Once a valid counter notice is received, Alpha AI may restore the removed content unless the original complainant files a court action seeking to prevent such restoration.
5. Repeat Infringer Policy
Alpha AI maintains a zero-tolerance policy for repeated copyright violations. Users who are found to be repeat infringers may have their access to Alpha AI services permanently suspended or terminated.
MARIDA LIMITED keeps an internal record of valid DMCA complaints and takes action consistent with applicable laws and internal enforcement standards.
6. Content Monitoring and Removal
While Alpha AI operates as a decentralized AI-analytics interface, it reserves the right to remove or disable access to content hosted on its website, blog, media channels, or affiliated platforms upon receipt of valid infringement notices.
This includes — but is not limited to — written materials, branding, visual content, videos, or AI-generated assets that misuse the Alpha AI brand, trademarks, or intellectual property.
7. Sharing of Claim Information
Alpha AI may share details of DMCA notices, including complainant contact information, with the alleged infringer as part of the counter-notification process. By submitting a DMCA claim, you consent to this information sharing as part of standard DMCA compliance procedure.
8. Modifications to This Policy
Alpha AI reserves the right to amend, update, or modify this DMCA Policy at any time without prior notice.
All revisions will be posted on this page with a new effective date.
